Conflicto de competencia suscitado entre el Juzgado Segundo Civil Municipal de Pereira, el Juzgado Cuarto Promiscuo Municipal de Chinchiná y el Juzgado Primero Civil Municipal de Santa Rosa de Cabal.
La Corte precisa que cuando el lugar de la vulneración o amenaza difiere del de sus efectos, prevalece la elección que haya hecho el accionante siempre y cuando no contradiga de las reglas de competencia territorial contempladas en el artículo 37 del Decreto 2591 de 1991.
Sin embargo, como en el presente caso no se puede utilizar esta pauta porque el lugar de presentación de la demanda, es decir, la ciudad de Pereira, no corresponde ni a la ocurrencia de los hechos presuntamente vulneradores, ni a sus posibles efectos, se desata el presente conflicto asignado el conocimiento de la solicitud de amparo formulada, al Juzgado Primero Civil Municipal de Santa Rosa de Cabal, lugar de domicilio del peticionario.

- Primero. DEJAR sin valor ni efecto el auto del 15 de septiembre de 2016 emitido por el Juzgado 1º Civil Municipal de Santa Rosa de Cabal, dentro de la acción de tutela de Wilford Sanz Restrepo en contra de la Inspección / Secretaria Municipal de Tránsito y Transporte de Chinchiná - Caldas.
- Segundo. REMITIR el expediente ICC-2773 al Juzgado 1º Civil Municipal de Santa Rosa de Cabal, para que asuma el conocimiento de la acción de tutela de la referencia.
- Tercero. Por la Secretaría General de la Corte, COMUNICAR al Juzgado
- Cuarto. Promiscuo Municipal de Chinchiná - Caldas y Juzgado
